Guess? sued K mart and others for $100 million.

The Los Angeles-based fashion jeans maker alleged that officials of K mart’s Designer Depot unit, its supplier, Fashion House of New York and Jeff Hamilton Inc., the exclusive licensee of Guess? men’s jeans, conspired to change labels and sell them as women’s jeans. Guess? had previously won a temporary restraining order to prevent the sale of the jeans. A K mart spokesman called the suit, filed in federal court in Los Angeles, “legal gimmickry of a novel sort.”
