Free Speech and Stern

Bradley Steffens’ letter (“Free Speech and the FCC,” Nov. 23) states that the Federal Communications Commission fining radio stations for program content isn’t against free speech but rather is democracy in action.
Leaving aside that the First Amendment (in fact, all the Bill of Rights) is anti-majoritarian in intent to begin with, I have one question for Steffens: How can it be that the FCC “reflect(s) the popular will” when the show they’ve decided to attack--the Howard Stern show--is the single most popular morning radio show in the United States?
